Article 2 – Applicable definitions
2.1. For the purposes of these General Terms and Conditions of Sale, the following terms shall have the meanings set out below:
2.1.1. ‘Buyer’: The natural or legal person who enters into a sales contract with the Seller for one of its Products. This person may be a Consumer or a Business.
2.1.2. “Catalogue”: the full range of Products and Services marketed by the Seller, which can be found on the website www.wattuneed.com, together with detailed descriptions.
2.1.3. “Account”: The personal interface that the Buyer may create and access via the website www.wattuneed.com, which allows them, amongst other things, to access their data, place orders and manage their profile and Account.
2.1.4. “Agreement”: The Agreement entered into between the Seller and the Buyer, comprising these General Terms and Conditions of Sale.
2.1.5. “Consumer”: The natural person acting for non-business purposes in accordance with Article I.1(2) of the Economic Law Code.
Article 3 – Purpose
3.1. These General Terms and Conditions of Sale, offered by the Seller, are intended to govern the sale of the Seller’s Products and Services to the Buyer.
Article 4 - Acceptance of the General Terms and Conditions of Sale
4.1. By placing an order for a Product or Service with the Seller, the Buyer unreservedly accepts these General Terms and Conditions, which they have had the opportunity to review in advance.
4.2. These General Terms and Conditions of Sale exclude, in the absence of the Seller’s written acceptance, all of the Buyer’s general and/or specific terms and conditions of purchase. No deviation from these General Terms and Conditions of Sale shall be permitted without the Seller’s written confirmation.
4.3. Placing an order also implies that the Buyer has read the Data Protection Policy.
Article 5 - Amendments to the General Terms and Conditions of Sale
5.1. The Seller reserves the right to amend these General Terms and Conditions of Sale at any time without notice. The applicable terms and conditions shall be those in force at the time the Buyer places the order.
Article 6 – Full Disclosure Clause
6.1. The Buyer acknowledges having received all relevant information concerning the Products sold by the Seller prior to the conclusion of the Sales Agreement.
Article 7 - Account Management
7.1. The Buyer may create an Account on the website www.wattuneed.com in order to view their orders and to benefit from various Features.
7.2. The Buyer is responsible for ensuring that the information provided when creating or managing their Account is valid and up to date.
7.3. The Buyer is responsible for the security and confidentiality of their Accounts, devices, passwords and login details. Consequently, the Buyer is liable for any activity carried out from or via their Account.
7.4. The Buyer shall not create more than one Account and undertakes not to create a new one if the first has been deleted by the Seller, regardless of the reason for such deletion, without first seeking the Seller’s authorisation.
7.5. The Seller reserves the right to refuse access to the Account, to close an Account, or to remove content if the Buyer holding said Account breaches any applicable law or any provision of the Terms and Conditions, including failure to pay an invoice by the due date, or engaging in abnormal behaviour that a normally prudent and diligent Buyer would not adopt in the course of normal use of their Account and the website.
Article 8 – Changes to Features
8.1. Given the need to develop the Features to meet the demands of Buyers, the Seller continually adapts and improves their scope. The Buyer therefore understands and accepts that the Features may be subject to changes. Some may be removed, modified or added, without the Buyer being able to assert any rights in respect of any of them.
Where possible, the Seller will inform the Buyer of the most significant changes by email or via a banner displayed on the Buyer’s Account.
OPERATIONAL CLAUSES
Article 9 - Range of Products Offered
9.1. All Products and Services offered by the Seller, regardless of the medium in which they are presented, are described in good faith and as accurately as possible in the Catalogue.
9.2. Any images presented to illustrate the Products and Services offered by the Seller have no contractual value.
9.3. Products are offered subject to availability.
9.4. The Seller may amend its range of Products and Services at any time.
9.5. The Seller is entitled to refuse to sell its Products depending on the availability and sufficiency of its stock or for any other legitimate reason. The Seller shall then inform the Buyer by email; the order will be automatically cancelled and no payment will be taken.
9.6. Any order shall only be accepted by the Seller upon written confirmation to the Buyer or upon actual delivery of the Products.
