General terms and conditions of use
PREAMBLE
These general terms and conditions of sale are concluded between the seller (see legal notice) and any person wishing to make a purchase via this website, hereinafter referred to as the buyer. By validating his/her order, the Customer declares that he/she accepts without reservation the terms of the order and the entirety of these general terms and conditions of sale and declares that he/she has the capacity to enter into a contract with the seller.
1. PURPOSE
The purpose of these terms and conditions of sale is to define the contractual relationship between the seller and the buyer and the terms and conditions applicable to any purchase made through this merchant site. These conditions of sale shall prevail over any other general or special conditions not expressly approved by the seller. The seller reserves the right to modify its general conditions of sale at any time without prior notice: the conditions applicable will be those in force at the date of the order by the buyer.
2. CHARACTERISTICS OF THE GOODS AND SERVICES OFFERED
The products or services offered are those presented on this commercial site and which are accompanied by a detailed description. These products and services are offered while stocks last (stock visible on the site). In the event of unavailability of the product or service after the order has been placed, the seller will inform the buyer by e-mail: the order will be automatically cancelled and no debit will be made.
3. PRICES
The prices shown on this website are inclusive of all taxes (VAT + other applicable taxes) and exclude processing and transport costs, which are applied and detailed when the order is placed. The seller reserves the right to modify its prices at any time: products and services are invoiced on the basis of the rates in force at the time the order is validated, subject to availability.
In the case of exports, the products are sold exclusive of tax. Any customs and import duties are always payable by the customer.
4. ORDERS
Purchasers wishing to purchase a product or service online via the site must follow the online ordering process, which includes an identification phase, a phase for checking and validating the products and services chosen, a payment phase in accordance with the conditions laid down and an order and payment confirmation phase. Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgement that you are fully aware of them and waiver of your right to invoke your own terms and conditions of purchase or any other terms and conditions. All of the data supplied and the recorded confirmation shall constitute proof of the transaction. The seller will send confirmation of the recorded order by e-mail, which will constitute acceptance of the order.
5. PAYMENT
The price is payable when the order is placed. Online payments are made via a secure system so that no third party can access the data transmitted on this occasion.
6. DELIVERY
Deliveries are made to the address indicated on the order form within the geographical limits specified above.
7. RETRACTION
Non-professional purchasers have a 14-day cooling-off period from the date of delivery of their order to return the product to the seller for exchange or reimbursement without penalty. Returns must be made in their complete original condition (packaging, accessories, instructions, etc.) so that they can be remarketed as new, and accompanied by a copy of the purchase invoice. The cost of returning the goods will be borne by the purchaser.
8. GUARANTEES
8.1. Consumers (private buyers). All goods supplied benefit from the legal guarantee of conformity of two years from delivery (articles 1649bis et seq. of the former Belgian Civil Code). If a proven lack of conformity appears within this period, the goods will be repaired or replaced free of charge for the consumer, including return and re-shipping costs. If repair and replacement are impossible or disproportionate, a price reduction or a refund will be applied in accordance with the law.
8.2. No defect found — re-invoicing. If inspection of the returned goods shows that the malfunction does not constitute a lack of conformity — in particular in the event of misuse, incorrect configuration or wiring, damage of external origin (overvoltage, lightning, humidity, fall...), modification of the product or normal wear — the guarantee does not apply and the seller reserves the right to invoice the buyer for the transport, diagnostic and inspection costs incurred. The buyer is informed before the return is organised.
8.3. Professional buyers. Goods benefit from the guarantee of articles 1641 et seq. of the former Civil Code (hidden defects). Return costs are borne by the buyer.
8.4. Beyond the above guarantees, only any manufacturer's commercial warranty applies, in accordance with its own terms. All claims must be made in accordance with the procedures specified on the site, with a motivated claim and a copy of the invoice.
8.5. Deliveries to overseas territories and outside the European Union.
8.5.1. Outermost Regions (ORs). For deliveries to Guadeloupe, Martinique, French Guiana, Réunion, Mayotte and Saint-Martin, European Union consumer law applies in full. The legal guarantee of conformity (point 8.1) applies under the same conditions as in mainland France: where a covered defect is established, repair or replacement is provided free of charge to the consumer.
However, where the cost of returning the product proves disproportionate in light of the value of the goods and the significance of the defect, Wattuneed shall apply the least costly remedy among those provided for by law (dispatch of a spare part, replacement without return of the defective product, price reduction or refund), so as to restore conformity without requiring the customer to arrange an unnecessary transatlantic shipment.
Where delivery is made to a freight forwarder or collection point located in mainland France or in Belgium, with the buyer being responsible for arranging onward shipment to the overseas territory, delivery is deemed to be completed at that collection point. The subsequent shipment, as well as any return of the product to that same point under the guarantee, are carried out at the expense and under the responsibility of the buyer or their agent.
8.5.2. Overseas Countries and Territories (OCTs) and destinations outside the European Union. For deliveries to New Caledonia, French Polynesia, Wallis and Futuna, Saint-Pierre and Miquelon, Saint-Barthélemy, the French Southern and Antarctic Lands, as well as to any destination located outside the European Union, European Union consumer law does not apply as of right. The costs of transport, collection and return of the product, on any basis whatsoever (guarantee, inspection or withdrawal), are borne by the buyer. A manufacturer's warranty may apply according to that manufacturer's own conditions.
8.5.3. Prior notice. In all cases, any costs that may be charged to the buyer are communicated to them before any return is arranged.
9. INTELLECTUAL PROPERTY RIGHTS
All elements of this site are and remain the exclusive intellectual property of the seller. They may only be used for private purposes. Any partial or total reproduction of all or part of the elements appearing on this site is prohibited.
10. SETTLEMENT OF DISPUTES
These general terms and conditions of sale are subject to Belgian law.
In the event of a dispute, the courts of Verviers shall have sole jurisdiction.
